1. Who we are
Kalash & Co makes miniature mandirs to order in the United Kingdom and sells them through www.kalashandco.com. Our address is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.
Reach us through the contact form at the bottom of this page. That is also how you cancel an order, complain, or make a claim under these terms.
2. How an order is made
Submitting the order form on this site is an offer to buy. It is not a completed purchase and it takes no payment.
We reply by email confirming the shikhar and finish you chose, the price, the postage to your country and the expected delivery date. The contract is formed when you agree to that email. You pay after that, and not before.
We may decline an order. If we do, we say so and nothing is charged.
3. What you are buying
- A decorative display piece, roughly 33.4 cm tall, 16 cm wide and 10.6 cm deep. It is not a toy and it is not a container for anything that burns.
- It is built with the shikhar and finish you chose, and both are fixed on the finished piece. We cannot put a different top on one that is already made, and there is no second top sold separately. That is about the piece itself, not about your rights: if it is not what you wanted, section 7 lets you send the whole thing back.
- No murti is included. The chamber takes a murti up to 8 by 9 by 4 cm through a 9.2 cm opening.
- Colour and surface vary slightly between pieces because each is made individually. Screens also render colour differently, so treat the swatches as a guide.
4. Safety
Keep it away from heat and open flame. No diyas, candles or incense in it, on it or beside it, and not on a sunny windowsill or above a radiator. The material softens at around 60 C and will deform. Using it as a shrine for lit offerings is a misuse of the product and we are not liable for damage or injury caused that way.
5. Price and payment
Prices are in pounds sterling. The price shown for the mandir is the total price of the piece, including any VAT. Postage is not included: it depends on where the piece is going, and we confirm it in the email before you pay.
The total we confirm in that email is what you pay us, and we do not add to it afterwards.
Orders outside the United Kingdom. Import VAT, customs duty and any handling fee the carrier charges are set by the country the piece is going to, not by us. They are not included in our price, we cannot tell you what they will be, and they are yours to pay. If a parcel is refused or abandoned because those charges are not paid, we refund the price of the piece less the postage and any charge the carrier passes back to us.
6. Delivery
We deliver to the United Kingdom and Europe, meaning the EEA and Switzerland. We do not ship elsewhere yet; if you ask us to, we will tell you so rather than take the order. Each piece is made after the order is agreed. Allow 5 to 7 working days for making, plus carriage. Delivery dates are estimates and not guaranteed, and risk passes to you when it is delivered.
If we have not delivered within 30 days of agreeing your order, and we have not agreed a longer time with you, you can cancel and have every penny back.
Check it on arrival. If it arrives damaged, tell us as soon as you reasonably can and keep the packaging until the claim is settled, because the carrier will ask for it. Nothing in that sentence is a deadline: your rights in sections 7 and 9 run for their own periods whatever you do here.
7. Changing your mind
You have 14 days from the day the mandir arrives to change your mind, for any reason or none, and you do not have to give one. This is your legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and it is on top of everything in section 9.
Before it arrives you can cancel at any time, from the moment you order. If you cancel before we have started making it, that is the end of it and you owe nothing.
To cancel, tell us through the contact form. A clear statement that you are cancelling is enough; there is no form to fill in and nothing to justify.
- Send the mandir back within 14 days of telling us, packed well enough to survive the journey.
- You pay the postage to return it. We do not collect it, and we cannot refund what you spend sending it.
- We refund within 14 days of the mandir reaching us, or of you showing us proof you sent it, whichever comes first.
- The refund includes what you paid us for standard delivery out to you. If you paid extra for a faster service, we refund the standard cost, not the upgrade.
- You can unwrap it and handle it the way you would in a shop. If it comes back worth less because it was handled beyond that, we may reduce the refund by the loss.
Commissions are different. A piece designed to your own specification, or personalised with a name or a date, cannot be sold to anybody else, so this 14-day right does not apply to one once we have begun. We tell you that plainly before we start, and you can still cancel at no cost up to that point. The four standard tops and two standard finishes on this site are not commissions: they are choices we offer everybody, and ordering one keeps you the full right above.
8. Refunds
Every refund goes back to the card or account that paid, in pounds sterling. We do not refund in credit, in vouchers, or against a future order unless you ask us to.
We do not charge a restocking fee, an admin fee, or a fee of any other name for cancelling or returning a piece.
What we cannot control is how long your bank takes to show the money once we have sent it. If it has not appeared a week after we tell you it has gone, come back to us and we will chase it with you.
9. If something is wrong with it
Under the Consumer Rights Act 2015 what we send you must be as described, fit for purpose and of satisfactory quality. If it is not, you have all of the following, in this order, and none of them costs you anything:
- Within 30 days of delivery you can reject it and have a full refund. You do not have to let us try to fix it first.
- After 30 days you can ask us to repair it or replace it. We do it within a reasonable time, without significant inconvenience to you, and we pay the postage both ways.
- If a repair or a replacement does not put it right, or we cannot do it in a reasonable time, you can keep it and have some of the price back, or reject it for a refund. In the first six months that refund is the full price.
For the first six months after delivery, a fault is taken to have been there when you got it unless we can show otherwise. After six months it is for you to show it was.
This covers faults. It does not cover damage from dropping it, from heat or flame, or from use outside what section 4 allows, and it does not cover the ordinary variation between pieces described in section 3.
10. Liability
We are responsible for loss you suffer that is a foreseeable result of us breaking these terms. We are not responsible for loss that was not foreseeable, or for damage caused by using the piece contrary to section 4.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
11. Using this website
The design of the mandir, the images and the text on this site are ours. Do not copy, reproduce or resell them. The measurements and descriptions are given in good faith and are as accurate as we can make them.
12. Complaints and governing law
Tell us first, through the contact form at the bottom of this page, and we will try to settle it. We are not a member of an alternative dispute resolution scheme, so if we cannot settle it between us the courts are the next step.
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can bring a claim in your own courts, and if you live outside the United Kingdom you keep the protection of the consumer law of the country you live in and can bring a claim there. Nothing here takes that away.
